ONLINE STORE TERMS AND CONDITIONS

§1 DEFINITIONS INCLUDED IN THE REGULATIONS


1.ORDER FORM – a form available on the website https://www.becomeremoteninja.com/ that allows for placing an order.

2.CUSTOMER – A User of the Service who intends to enter into or has entered into a Sales Contract with the Seller.

3.CONSUMER – A natural person who performs a legal action with an entrepreneur not directly related to their commercial or professional activity.

4.ENTREPRENEUR – A natural person, legal entity, and organizational unit not being a legal entity, which is granted legal capacity by law, conducting commercial or professional activity in their own name.

5.PRODUCT – A movable good available in the store that is the subject of the Sales Contract between the Customer and the Seller.

6.REGULATIONS – These terms and conditions of the store.

7.STORE – The online store of the Service Provider operating at the address https://www.becomeremoteninja.com/

8.SELLER, SERVICE PROVIDER – Remote Ninja

9.SALES CONTRACT – A Sales Contract for Products concluded between the Customer and the Seller via the store.

10.ORDER – A declaration of the Customer’s intent that constitutes an offer to enter into a Sales Contract for Products with the Seller.

11.PRICE – The value expressed in monetary units that the Customer is obliged to pay to the Seller for the Product.


§2 GENERAL PROVISIONS


1.The store operates in accordance with the rules defined in these Regulations.

2.The Regulations define the conditions for the conclusion and termination of Sales Contracts for Products, as well as the procedure for complaints, types and scope of electronic services provided by the store, rules for the provision of these services, and conditions for concluding and terminating contracts for electronic services.

3.Each User of the Service, when performing actions aimed at using the Store's Electronic Services, is obliged to comply with the provisions of these Regulations.

4.In matters not regulated by these Regulations, the provisions of:

a) the Act on Electronic Services of July 18, 2002,

b) the Consumer Rights Act of May 30, 2014,

c) the Act on Out-of-Court Consumer Dispute Resolution of September 23, 2016,

d) the Civil Code of April 23, 1964, and other applicable Polish legal provisions will apply.


§3 INFORMATION ABOUT PRODUCTS AND THEIR ORDER


1.The store sells Products via the Internet.

2.The products offered in the store are new, in accordance with the contract, and have been legally introduced into the Polish market.

3.The information displayed on the store’s website does not constitute an offer within the meaning of legal provisions. The Customer, by placing an Order, makes an offer to purchase the Product specified in its description.

4.The price of the Product shown on the website of the store is in United States Dollars (USD) and includes all components.

5.Orders can be placed through the website using the Order Form in the store 24 hours a day, all year round.

6.The condition for placing an Order in the store by the Customer is to know the Regulations and accept its provisions when placing the Order.


§4 CONCLUSION OF THE SALES CONTRACT


1.To conclude the Sales Contract, the Customer must first place an Order in the manner provided by the Seller, in accordance with §3 points 5 and 6 of the Regulations.

2.After placing the Order, the Seller immediately confirms its receipt.

3.The confirmation of acceptance of the Order, mentioned in point 2 of this paragraph, obligates the Customer to their Order. The confirmation of receipt of the Order is made by sending an email.

4.The confirmation of receipt of the Order includes:

a) confirmation of all essential elements of the Order,

b) the form for withdrawal from the contract,

c) these Regulations containing instructions on the right to withdraw from the contract.

5.At the moment the Customer receives the email mentioned in point 4 of this paragraph, the Sales Contract between the Customer and the Seller is concluded.

6.Each Sales Contract will be confirmed with a proof of purchase that will be attached to the Product.


§5 PAYMENT METHODS


1.The Seller provides the following payment methods: payment via the electronic payment system.

2.In the case of payment via the electronic payment system, the Customer must make the payment before the execution of the Order begins. The electronic payment system allows payment via credit card or fast transfer from selected Polish banks.

3.The Customer is obliged to pay the price for the Sales Contract within 3 working days from the date of its conclusion unless the Sales Contract provides otherwise.

4.The Product will be sent only after payment is made.


§6 COST, DELIVERY TIME, AND METHODS OF DELIVERY OF THE PRODUCT


1.The delivery costs of the Product, covered by the Customer, will be established during the Order process.

2.The Product is delivered electronically by email.


§7 RIGHT TO WITHDRAW FROM THE CONTRACT


1.The Consumer may withdraw from the Product purchased in the Service without providing a reason within 60 days from the date of its receipt. To meet this deadline, it is sufficient to send a withdrawal statement to the Seller’s address or to the email address provided in the Regulations.

2.In the case of withdrawal from a distance contract, the contract is considered not concluded.

3.In the case of withdrawal from a concluded contract, the Consumer is obliged to return the Product no later than 90 days after the day of withdrawal from the contract, and in the case of a Product based on access granted to a platform, the Seller will block further access from the moment the withdrawal statement is submitted.

4.The Seller guarantees the refund of the price and the costs paid by the Customer, including delivery costs of the Products sold to the Consumer.

5.The Consumer is responsible for any decrease in the value of the goods resulting from their use in a manner that exceeds what is necessary to establish the nature, characteristics, and functioning of the goods.

6.All refunds will be processed by the Seller no later than 60 days after receiving the withdrawal statement from the Contract, using the same payment method used by the Consumer, unless the Consumer agrees to a different refund method. The refund will not incur additional costs. The Seller may withhold the refund of the funds received from the Consumer until the Product is returned.

7.The Seller guarantees the Customer the right to withdraw from the Contract within 60 days from the date of its conclusion if the Product does not satisfy the Customer. To use the satisfaction guarantee, it is enough to send a statement to the Seller's address or to the email address provided in the Regulations. In such a case, the provisions of points 1-6 above will apply.


§8 TYPE AND SCOPE OF ELECTRONIC SERVICES


1.The Service Provider allows the use of the Electronic Service, which is the conclusion of Sales Contracts for Products, through the store.

2.The provision of the Electronic Service for the Users of the Service in the store is carried out under the conditions specified in the Regulations.

3.The Service Provider has the right to publish advertising content on the store’s website. This content is an integral part of the store and the materials presented on it.


§9 CONDITIONS FOR PROVIDING AND CONCLUDING CONTRACTS FOR ELECTRONIC SERVICES


1.The provision of the Electronic Service specified in §9 point 1 of the Regulations by the Service Provider is free of charge.

2.The contract for the provision of the Electronic Service, which consists of enabling the placing of an Order in the store, is concluded for a definite period and is terminated at the moment the Order is placed or when the User ceases its execution.

3.Technical requirements necessary for cooperation with the information technology system used by the Service Provider:

a) a computer (or mobile device) with access to the Internet,

b) access to email,

c) a web browser,

d) enabling Cookies and Javascript in the browser.

4.The User of the Service is obliged to use the store in accordance with the law and good manners, taking into account respect for personal goods and the intellectual property rights of third parties.

5.The User of the Service is obliged to provide data consistent with the actual state of affairs.

a) The User of the Service is prohibited from providing illegal content.


§10 COMPLAINTS RELATED TO THE PROVISION OF ELECTRONIC SERVICES


1.Complaints related to the provision of the Electronic Service through the store can be submitted by the User of the Service via email at: contact@becomeremoteninja.com

2.The email message mentioned above should provide as much information and circumstances related to the subject of the complaint, in particular the type and date of the anomaly, as well as contact details. The provided information will greatly facilitate and speed up the consideration of the complaint by the Service Provider.

3.The consideration of the complaint by the Service Provider is carried out immediately, no later than within 60 days from its submission.

4.The response of the Service Provider regarding the complaint is sent to the email address of the User of the Service provided in the complaint notification or by another way provided by the User of the Service.


§11 FINAL PROVISIONS


1.Contracts concluded through the store are governed by Polish law.

2.In case any part of the Regulations is incompatible with applicable law, the relevant Polish legal provisions will apply instead of the challenged article of the Regulations.

3.All disputes arising from Sales Contracts between the store and Consumers will first be resolved through negotiations, with the intention of resolving the conflict amicably, in accordance with the law on out-of-court resolution of consumer disputes. If this is not possible, or if it is unsatisfactory for either party, disputes will be resolved by the competent court, in accordance with point 4 of this paragraph.

4.Any dispute arising between the Service Provider and the User of the Service (Customer) who is also a Consumer will be submitted to the competent courts according to the provisions of the Civil Procedure Code of November 17, 1964.

5.The Customer who is a Consumer also has the right to use extrajudicial methods of dispute resolution, in particular by submitting a request to initiate mediation or a request for the case to be considered by an arbitration court after completing the complaint procedure (the request can be downloaded from the website http://www.uokik.gov.pl/download.php?plik=6223). The list of Permanent Consumer Arbitration Courts operating in Provincial Commercial Inspection Offices is available at: http://www.uokik.gov.pl/wazne_adresy.php#faq596. The Consumer may also use the free assistance of a county (city) consumer advocate or a social organization whose statutory tasks include consumer protection. Seeking extrajudicial claims after completing the complaint procedure is free of charge.

6.The Consumer, to resolve a conflict amicably, may, in particular, submit a complaint via the Online Dispute Resolution (ODR) platform, available at: http://ec.europa.eu/consumers/odr/.
